The CRISTAHLEA Online Boutique service is exclusively available to its end users: you, the customer (hereinafter referred to as “the Customer” or “You”).

Please be advised that the use of www.cristahlea.net and all sale and purchases on our website and via email or social media are subject to the following Terms and Conditions of Sale (“Terms”). At the time you place your order on www.cristahlea.net you are deemed to have fully read and accepted the Terms. The Terms are subject to change by us at any time and at our sole discretion without any prior written notice to you. We recommend that you read the following Terms & Conditions prior to making any purchase as the below Terms & Conditions are subject to change.

The terms also govern the legal relationship between you and CRISTAHLEA (hereinafter referred to as "the Vendor" or "We" or "Us"). By accessing and using www.cristahlea.net or by making a purchase or a pre-order purchase, you agree to be bound by these Terms. If you do not agree with any of these Terms please do not submit your order for the purchase of products on www.cristahlea.net. Please also carefully review our PRIVACY POLICY (/PRIVACY) before placing an order through this Website.

CURRENCY

The price of each CRISTAHLEA product is displayed in Australian Dollars (AUD). CRISTAHLEA product prices are inclusive of Australian goods and service tax (GST) and are shown at Checkout. International orders are not subject to Australian GST.

INTERNATIONAL ORDERS - IMPORT DUTIES & TAXES

CRISTAHLEA product prices as listed on www.cristahlea.net exclude customs fees, import taxes, brokerage fees and/or duties. Orders made outside of Australia may be subject to import duties and taxes for the country that the goods are being delivered to. Duties and taxes are calculated based on the total value of your order. CRISTAHLEA is not responsible or liable for any customs fees, import taxes, brokerage fees, duties or local taxes incurred by your order. You will be responsible and liable for all import taxes, brokerage fees, duties, custom fees or local taxes levied by the country you are shipping to. Payment of these amounts will be necessary to release your order from customs on arrival. We advise you to contact your local customs office for more details about your country's duties and taxes before placing an order.

SHIPPING FEES

Shipping fees are calculated based on your country zone and are added at the final stage of checkout. Once you have completed your purchase, please allow approximately 24-48 hours for the processing of your order to be completed for shipping.

NON-ACCEPTANCE OF ORDERS

We reserve the right at any time after receipt of your order to decline or limit your purchase for any reason, whether or not your credit card has been charged. Any payment(s) will be refunded in the original form of payment. The non-acceptance of an online order may be the result of one or more of the following:

  • We are unable to obtain authorisation for your payment;

  • The information you put in your order form is incomplete or incorrect;

  • A product is no longer available.

RETURNS AND EXCHANGES POLICY

The Returns Policy as listed below is for Clothing Products purchased on the website, via telephone and via email and forms an integral part of these General Terms and Conditions of Sale and, consequently, shall be deemed to be fully read and accepted by you at the time your order is placed.

Change of Mind

Due to the hand made nature of CRISTAHLEA garments, when placing your order, please choose carefully as CRISTAHLEA products are unable to be exchanged nor returned for refunds for change of mind. CRISTAHLEA also does not exchange products for other styles for change of mind. CRISTAHLEA does not refund made to order products for change of mind.

Exchange for Change of Size - Haute Couture Collection

Due to the hand made nature of CRISTAHLEA Haute Couture garments, when placing your order, please choose carefully as CRISTAHLEA Haute Couture Garments are unable to be exchanged nor returned for refunds for change of mind nor change of size.

Exchange for Change of Size Only - Ready To Wear Collection

CRISTAHLEA may only exchange a product for a different size within 7 days of receipt of your order and providing that the following is met:

i)The product has not been worn or used.

ii)The product is in its original state, not damaged and all original tags are on the garment.

iv)The product has not been altered, dry cleaned or otherwise modified.

Please also note, the quoted production times for the applicable style will apply for a different size. We therefore recommend you use the provided CRISTAHLEA Size Guide to avoid size exchanges or contact CRISTAHLEA for assistance when selecting your size.If you do not contact CRISTAHLEA regarding your purchase, we may refuse your request for change of size.

In order for CRISTAHLEA to properly assess your claim for an exchange of size, please contact CRISTAHLEA within 7 days of receipt of your original purchase. If you do not contact CRISTAHLEA regarding your concern within 7 days of receiving your purchase, we may refuse your request.

Please contact CRISTAHLEA directly via email contact@cristahlea.net or call + 61 (4) 20970480. Please quote your invoice number and also the size you wish to exchange the original size for. Once you have made contact with a CRISTAHLEA representative, you will be emailed a CRISTAHLEA Return Form which must be correctly completed and submitted back to CRISTAHLEA within (3) business days from the date you made your inquiry for review and acceptance.

Please be advised that the exchange of size will not be processed until the item(s) have been returned and inspected by CRISTAHLEA. All International duties, shipping, taxes and fees for the return of your purchased products to CRISTAHLEA is at your own expense. CRISTAHLEA does not refund initial shipping charges or taxes and duties for a size exchange. When your new size order is ready, you will be responsible for shipping charges and duties.

CRISTAHLEA accepts an exchange of size only. Refunds are not accepted. Please be advised, if your size is not available at time of exchange, you will be offered a credit note or a wait time of up to 3 months for your size. CRISTAHLEA will do its utmost to accomodate your request.

Jewellery Items are unable to be returned or exchanged.

Sale Items - Ready To Wear Collection

Sale items are not eligible for return, refund or exchange. 

International Garment Purchases - Shipping

International garment purchases that are being returned for an exchange of size, the shipping costs will be the responsibility of the customer.

TERMS OF PRE-ORDERS FOR GARMENTS, ACCESSORIES & SHOES

a) Full Fee. Some articles are available as a pre-order exclusive when items are launched. The full amount of the article is payable at time of order. At the time of placing your order for a Pre-Order Item, the full amount is required at time of purchase. Please allow the allocated time indicated in the item description for the shipment or collection of your order. CHRISTAHLEA reserves the right to shorten or extend the time frame but will always aim to deliver on the expected date.

CANCELATIONS & AMENDMENTS TO PRE-ORDERS OF: GARMENT, ACCESSORIES & SHOES

Please make your Pre-Order purchase carefully, as Pre-Orders are unable to be cancelled and/or refunded once the order has been made.

CRISTAHLEA will not be able to make any changes to the size, style, colour, quantity, or type of pre-Order Product once the Order has been received by CRISTAHLEA.

Returns & Exchanges for Shoes

CRISTAHLEA accepts an exchange of size only. Refunds are not accepted.

Shoes must be tried on a carpet surface only.

All shoes must be returned in their original shoe box and dust bag. Shoes must also be returned with all original packaging. Shoes that are worn and/or have not been returned in the original box and with all original packaging, will not be accepted for return. Shoes that have scratches on soles are also not eligible for return. CRISTAHLEA may return shoes that are deemed unacceptable for return back to you. In the case that your size is not available and out of stock, a credit voucher will be offered or a 4-6 week wait time for your size to be made. All return shipping costs are at the expense of the customer and must be sent back to CRISTAHLEA in a durable and protected outer box.

GARMENT SIZING  & COLOUR

Please carefully read the provided CRISTAHLEA Size Guide to ensure you order the correct size. Due to the handmade nature of garment manufacturing, each style may vary slightly in size. CRISTAHLEA garments are hand embellished and handmade. Slight differences in manufacture and embellishment processes may also occur, and slight colour variations may occur due to the dye process. CRISTAHLEA will not be held responsible for any differences from those advertised. 

PRODUCT DELIVERY

The estimated delivery window is noted on the Product page of the respective CRISTAHLEA product.

DELIVERY DATE DELAYS

In the unlikely occasion that your order is delayed, CRISTAHLEA will make contact with you as soon as possible. Any delays, production changes, or cancellations will be communicated to you. Any such delay does not warrant a cancellation nor refund.

SHIPPING

Once you order is complete, please allow approximately 24-48 hours for the processing of your order to be completed for shipping. All orders shipped from the CRISTAHLEA head office to locations in Australia are shipped currently via DHL with signature on delivery. All orders shipped from the CRISTAHLEA head office to locations outside of Australia are shipped via UPS with signature on delivery. Please be advised that any shipping time frame provided on www.cristahlea.net may vary from time to time for any reason. We are not responsible or liable for any local or international shipping/customs delays. CRISTAHLEA is also not responsible for any loss, liability or damage that results from the shipping service provider, shipping insurance is optional and can be quoted to you upon request for an additional charge, we do highly recommend you insure your goods. If a delay has occurred to the delivery of your order due to a Force Majeure event, and it continues for more than 21 days, CRISTAHLEA may terminate the sale by giving you 7 days notice. 

PRICE VARIATION TO PRODUCTS ONLINE

In the unlikely instance that a Product price or description has been listed incorrectly on the website, CRISTAHLEA shall have the right to refuse or cancel any orders.

PRODUCT STOCK UPDATES

CRISTAHLEA may discontinue products on the website at any time.

In the unlikely instance that your purchased product(s) is no longer available once we have received your order, we shall contact you as soon as possible via the email address or telephone and provide you a credit for a different product or a refund for the original unfulfilled order.

RETURN SHIPMENT POLICY

CRISTAHLEA only accepts return shipments with either FedEX, DHL or UPS with a provided tracking number. Returns sent with any other carriers may not be accepted. CRISTAHLEA does not accept liability for any items and shipments that are returned in the case of exchanges and or faulty items. Please be advised that you are responsible for the correct packaging of your items so as to ensure that they are received by us undamaged during transit. Please be advised that CRISTAHLEA cannot be held responsible for parcels that are detained at customs due to any reasons. Please ensure that all of the required documentation for customs clearance are provided.

FAULTY PRODUCTS

If you believe your garment is faulty, please email CRISTAHLEA. CRISTAHLEA will determine in its sole judgment and discretion, whether a Product is faulty and can be considered for return and refund.

Products that are believed to be damaged or have a manufacturing fault will only be accepted for review within ONE (1) months of purchase. Items that become damaged as a result of normal wear and tear are not considered to be faulty and will not be refunded. Please adhere to all care instructions as per the garments tag, failure to do so will void all refunds and returns.

CRISTAHLEA will determine, in its sole judgment and discretion, whether the damage is as a result of normal wear and tear or some other reason. Damaged or faulty products will be replaced or repaired. Where possible we will offer to repair the faulty item. If a product cannot be replaced or repaired, you are entitled to a full refund. 

Once items have been returned and we have confirmed the acceptance of the faulty product, CRISTAHLEA shall refund the original purchase amount.

PRODUCT COLOURS AND MONITOR CALIBRATION

CRISTAHLEA has made every effort possible to ensure the colours of fabrics and embellishments are displayed as accurately as possible. CRISTAHLEA however, cannot guarantee your computer’s monitor will accurately display the true colour of the garment.

LIMITATION OF LIABILITY

CRISTAHLEA’s sole and maximum liability to you is limited to the amount paid by you for your order. This does not apply should there be a jurisdictional exclusion of this term where your order was made by you, noting however, should there by any dispute, you agree to the exclusive jurisdiction of the Victorian courts of Australia. 

CRISTAHLEA or its suppliers does not have any liability or obligation to you or to any other person or entity for loss of profits, loss of business, or for incidental, punitive, exemplary special or consequential damage whether contractual, tortious, products liability, arising out of or in connection to the use, the purchase and/or delivery (or lack of delivery) or use in any way of the products.
