Welcome to the CRISTAHLEA Website. Please be advised that the use of our website and all purchases are subject to the following Terms and Conditions of Sale. 

The following Terms govern the offer and sale of (“Products”) on our web site ("www.cristahlea.net") and our e-commerce business services are available exclusively to its end users, i.e. the ("Consumers"). The products purchased on www.cristahlea.net are directly sold by CRISTAHLEA with registered offices 16 High Street Glen Iris 3146, Melbourne Victoria Australia, ABN 15171776722. The legal relationship between you the customer and CRISTAHLEA (hereinafter referred to as "the Vendor" or "We" or "Us"), is governed by the following Terms and Conditions of Sale.  By accessing and using the CRISTAHLEA website or by making  a purchase, or, a pre-order purchase, you are agreeing to be bound by these Terms and Conditions (“the terms”). Should you not agree with certain provisions of these terms please do not submit your order for the purchase of products on this website. 

ORDER ACCEPTANCE

All CRISTAHLEA products are displayed in Australian Dollars (AUD).

Once you have purchased your product online, all CRISTAHLEA online orders are subject to email verification. Once you have made your purchase, you will receive an immediate purchase order receipt from us via email. This purchase order receipt contains a summary of the following:

  1. Information related to your purchase;
  2. Product description;
  3. Price description;
  4. Terms of payment; 
  5. General Terms and Conditions of Sale; 
  6. Return policy 

CRISTAHLEA will send you a secondary acknowledgment email verification within 24 hours of receiving the initial purchase order receipt. You must respond to the secondary email within 24 hours. The secondary verification process officially sanctions your online purchase with us. Failure to respond to the secondary email verification may result in the cancellation of your order.

Please be advised that you will also be sent email confirmation once your order is ready to for shipment.

NON-ACCEPTANCE OF ORDERS

The Vendor reserves the right at any time after receipt of your order to accept, decline, or limit your order for any reason, whether or not your credit card has been charged. If applicable, your order will be refunded in the original form of payment.

Non-acceptance of an online order may be a result of one of the following:

  1. Insufficient guarantees of solvency; 
  2. Inability to obtain authorization for your payment;
  3. Orders are incomplete or incorrect;
  4. Products are no longer available;
  5. The identification of a pricing or product description error;
  6. Failure to agree to the criteria as set out in the Terms and Conditions of Sales and Returns and Exchanges Policy at checkout.

PAYMENT

Upon submitting an order to us through our website, you represent and warrant the following:

  1. All payment details provided for your order are valid and correct; 
  2. Payment will be made in full once your order is accepted and processed online; 
  3. When you place an order online you confirm that you are the person referred to in the billing details you have provided.

SHIPPING

When you place an order with CRISTAHLEA, you accept the following shipping terms set forth as outlined below. 

  1. All orders shipped from CRISTAHLEA head office within Australia will be sent via Australia Registered Post;
  2. All international deliveries outside of Australia are shipped via DHL and shipping costs are charged accordingly at check out. 

EXPECTED DELIVERY TIMES

When you place an order with CRISTAHLEA, you accept the following expected delivery terms as outlined below. The terms  shall be deemed to be fully read and accepted by you at the time your order is finalised online. 

  1. All posted shipping time frames as provided to you on the website may vary from item to item depending on your order;
  2. Proposed and posted local and international online shipping time frames are contingent upon credit card approval and may be delayed should we experience difficulties in obtaining authorization of payment; 
  3. All delivery time frames as provided to you on the website are estimations only and we cannot be held responsible for any delays in delivery;
  4.  CRISTAHLEA is not responsible for any local or international shipping delays and or those caused by any international customs clearance processes;
  5.  CRISTAHLEA is not responsible for any loss or liability or damage that may result from leaving your package at the shipping address without a signature. 

CUSTOMS & DUTIES

Please be advised that you accept the following International Customs and Duties Terms when you place an order with us:  

  1. Final Product prices include local and international shipping costs however they exclude all international customs fees, import taxes, brokerage fees or duties. We are not responsible for any customs fees incurred on your order. For this reason we recommend that you refer to your local customs office for more details about your country's duties and taxes before placing an order.
  2. As the recipient, you will be responsible and liable for all international import duties, customs and local sales taxes levied by the country you are shipping to. Payment of these amounts will be necessary to release your order from customs on arrival;
  3. The customs fees for your order depend on the destination country. 

STOCK UPDATES

CRISTAHLEA attempts to be as accurate as possible with Product availability, Product stock levels, Product pricing and Product descriptions however, we do not warrant that they are always accurate on the Site. 

CRISTAHLEA asks you to please be aware of the following prior to making your final purchase:

  1. CRISTAHLEA may discontinue Products on the website at any time without notice;
  2. All CRISTAHLEA Products are subject to stock levels and availability;
  3. If, due to unforeseen circumstances your product(s) are no longer available once the we have received your order, we shall contact you immediately via the email address or telephone number you have provided at the time of your order. We will immediately issue a refund to your credit or debit card account in the amount of the charge.

PRICE VARIATION TO PRODUCTS ONLINE

Please be aware of the following prior to making your final purchase with us online. 

  1. Prices on the CRISTAHLEA website are subject to change;
  2. CRISTAHLEA reserves the right to make adjustments to prices due to variants in market conditions, manufacturer price changes, errors in advertisements, and other extenuating circumstances; 
  3. CRISTAHLEA shall have the right to refuse or cancel any orders for Products that have been listed at the incorrect price;
  4. In the unlikely instance that a Product price or description has been listed incorrectly on our website, we will contact you at the email address or telephone number you provided when placing your order;
  5. Please be advised that you will have the option to reconfirm your order at the correct price or alternatively, you may cancel your order;
  6. If your credit or debit card has already been charged for the purchase and you choose to cancel your order, we shall immediately issue a refund to your credit or debit card in the amount of the charge and re-confirm the cancelation of your order via email.

PRODUCT COLOURS AND MONITOR CALIBRATION

Every care has been taken to ensure that the photographic representation, description and specification of each product is accurate. However, while the reproduction of colours is a close representation, a slight variation in the actual goods may occur. We are therefore unable to guarantee that the product images you see are an accurate representation of the actual merchandise. 

We have made every effort possible to ensure the colors are displayed as accurately as possible. CRISTAHLEA however, cannot guarantee your computer’s monitor will accurately display the true color. RETURNS AND EXCHANGES

The Returns Policy as listed below is for Products purchased on the website and forms an integral part of these General Terms and Conditions of Sale and, consequently, shall be deemed to be fully read and accepted by you at the time your order is placed. Please be advised that any request for a return, exchange or refund of a CRISTAHLEA Product is subject to the following Terms.

  1. CRISTAHLEA does not exchange products for change of mind;
  2. CRISTAHLEA does not refund products for change of mind;
  3. CRISTAHLEA can only exchange an item for a different size, (providing the new size you require is available at the time of your exchange inquiry) within 7 days of receipt of your original purchase;
  4. In all cases of an exchange return and or refund, you must retain and produce proof of purchase, excluding custom orders. There are no Exchanges or Refunds for Custom CRISTAHLEA Orders
  5. In all cases, products must be returned in their original packaging including all packaging materials and CRISTAHLEA tags. All other packaging should all be included where initially provided;
  6. Please be advised that all exchange, returns and refunds will not be processed until the item(s) have been returned and inspected by CRISTAHLEA;
  7. Once we have received your exchanged item and all the conditions have been met, you will receive a confirmation telephone call and or email disclosing the acceptance of your return;
  8. All International duties, shipping, taxes and fees for the return of your purchased products to CRISTAHLEA is at your own expense;
  9. CRISTAHLEA does not refund initial shipping charges for returned Products, other than for faulty items.

SALE ITEMS

  1. CRISTAHLEA does not refund sale items;
  2. CRISTAHLEA can only exchange a sale item for a different size within 7 days of receipt of your original purchase (providing the new size you require is available at the time of your exchange inquiry);
  3. In all cases of an exchange return, you must retain and produce proof of purchase;
  4. The garment you require to exchange for another size must be in its original condition as received by you, including all tags and original packaging material;
  5. Please be advised that an exchange will not be processed until the item(s) have been returned and inspected by CRISTAHLEA;
  6. The garment you require to exchange for another size must be in its original condition as received by you, including all tags and original packaging material;
  7. In all cases, products must not have been used, worn, dry cleaned or damaged and any returned products which are damaged and do not include the packaging materials, soiled, or altered may not be accepted and will be returned to you;

  9. CRISTAHLEA does not refund initial shipping charges for returned Products, other than for faulty sale items.

HOW TO EXCHANGE & RETURN AN ITEM VIA PHONE

If you have any questions pertaining to the exchange and or return of an item,  please follow the instructions below.

RETURN, EXCHANGE & REFUND ENQUIRIES BY PHONE 

  1. In order for CRISTAHLEA to properly assess your claim for an exchange or return, please contact CRISTAHLEA  within 7 days of receipt of your original purchase.  If you do not contact CRISTAHLEA regarding your concern within 7 days of receiving your purchase, we may refuse your request; 
  2. If you would like to exchange, return or receive a refund on your purchase, please contact CRISTAHLEA directly via email enquiries@cristahlea.net or via by telephone call on + 61 (3) 9886 0540; 
  3. Please have your invoice number ready at the time of your telephone inquiry so that we may be able to assess you promptly;
  4. Once you have made contact with a CRISTAHLEA representative, you will be sent a CRISTAHLEA Return Form which must be correctly completed and submitted within (3) days from the date you made your inquiry to receive your exchange, return or refund of your item;
  5. Once you have completed the CRISTAHLEA Return Form, please forward the appropriate returns form to the following address: CRISTAHLEA 16 High Street Glen Iris 3146 Melbourne Victoria Australia
  6. Once we have received your exchanged item and all the conditions have been met, you will receive a confirmation telephone call and or email disclosing the acceptance of your return, exchange and or refund.

RETURN, EXCHANGE & REFUND ENQUIRIES VIA EMAIL

In the instance of exchanges, returns and refunds via email, please contact CRISTAHLEA as stated in the guideline below. 

  1. In order for CRISTAHLEA to properly assess your claim for an exchange or return, please contact CRISTAHLEA  within (7) days of receipt of your original purchase.  If you do not contact CRISTAHLEA regarding your concern within (7) days of receiving your purchase, we may refuse your request; 
  2. Please clearly state your intention to exchange your purchase by sending an email to: contact@cristahlea.net 
  3. In all instances of email enquiries, please clearly state your CRISTAHLEA invoice number so that we may be able to assess your inquiry promptly;
  4. Please allow 24 hours for a reply to your email enquiry;
  5. Once you have made contact with a CRISTAHLEA representative, you will be sent an email with a CRISTAHLEA Return Form. The Return Form must be correctly completed and submitted via email within (3) days from the date you made your inquiry to receive your exchange, return or refund of your item;
  6. Once we have received your item and all the conditions have been met, you will receive a confirmation e-mail disclosing the acceptance of your exchange, return or refund.

LATE RETURNS

Any product that is returned outside of the fourteen (7) day return policy are at the discretion of CRISTAHLEA and may not be accepted. 

RETURN SHIPMENT TERMS

  1. CRISTAHLEA highly recommends the selection of a shipping service that permits you to trace the delivery of your returned item at any time;
  2. CRISTAHLEA does not accept liability for any items and shipments that are returned in the case of exchanges and or faulty items;
  3. Please be advised that you are responsible for safely packaging your items so as to ensure that they are received by us undamaged during transit; 
  4. Please be advised that CRISTAHLEA cannot be held responsible for parcels that are detained at customs due to insufficient documentation upon return.
  5. Please verify that you have accurately completed and included with your parcel all the necessary documentation for customs clearance.

FAULTY ITEMS 

  1. CRISTAHLEA will determine in its sole judgment and discretion, whether a Product is faulty and can be considered for return and refund;
  2. CRISTAHLEA shall accept the return and refund of a Product only if the Product has been received by you with major damage or manufacturing faults which have occurred within one (1) month of purchase; 
  3. In all instances and where possible, CRISTAHLEA will offer to repair the faulty Product where possible (subject to availability). If a product cannot be replaced or repaired, you are entitled to a full refund;
  4. Items cannot be returned as a result of normal wear and tear or some other reason. Items that become damaged as a result of normal wear and tear are not considered to be faulty;
  5. Once items have been returned and we have confirmed the acceptance of the faulty product,  CRISTAHLEA shall refund amounts within seven (7) days from the date on which we received your faulty item;
  6. Refunds will be made for the original purchase amount against the original form of tender. Please be advised that refund times will depend on the Credit and or Debit Card company’s policies;
  7. If the return right is exercised in conformity with the provisions set forth in the above section (1-5), CRISTAHLEA shall refund original shipping, duties, taxes and any other fees. Please ensure that you provide  evidence of such shipping, duties, taxes, other fees, costs paid in order to reimburse you.
